We grant you a limited, non-exclusive, non-transferable license to use the Services for personal or internal business use, subject to these Terms.

5) Payments & No-Refund Policy

1. Certain features may require payment. Prices and features may change from time to time.
2. No Refunds: All payments are final and non-refundable to the fullest extent permitted by law.
3. Try Before You Buy: You should evaluate the free/demo version of the App (or trial access) before making any purchase.
4. Subscriptions (if any) renew automatically unless canceled prior to renewal according to the instructions provided in your account or in the platform store.

6) Data Loss Disclaimer

1. No Liability for Data Loss: To the maximum extent permitted by law, the Company is not responsible or liable for any data loss, corruption, deletion, unauthorized access, or inability to access data arising out of or related to your use of the Services.
2. Your Backups: You are solely responsible for maintaining appropriate backups and safeguards for your data.
3. The Services are provided “AS IS” and do not guarantee data retention, availability, integrity, or security.

7) Third-Party Links & Services

The Services may link to or integrate with third-party sites or services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and may be governed by additional terms.

8) Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Eactive Technologies AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or if we discontinue the Services. Upon termination, your right to use the Services ceases immediately.

11) Governing Law & Disputes

These Terms are governed by the laws of Mumbai, Maharashtra, India, without regard to its conflict of law rules. Venue and exclusive jurisdiction shall lie in the courts located in Mumbai, Maharashtra, India. You agree to the personal jurisdiction of such courts.

12) Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Website/App and the “Effective Date” will be updated. Your continued use of the Services after the revised Terms become effective constitutes acceptance.
